LEE COUNTY, Fla.- The Lee County Sheriff’s Office is responding to a lawsuit filed against a deputy who hit and killed a Cape Coral teen.

The State Attorney’s Office cleared Deputy Douglas Hood of any wrongdoing in the death of 15-year-old Austin Dukette.

The teen was riding his bike to school in August 2014 when he was hit by the deputy’s car and killed.

Since then, the boy’s family sued the sheriff’s office and Deputy Hood, seeking $15,000 in damages. They allege that Deputy Hood was negligent.

The sheriff’s office has denied the allegations and wants the case to go to a jury.
