Cape Coral officer accused of having sex with minor faces new allegations

FORT MYERS, Fla.- A second teenager has come forward in the case of a former Cape Coral police officer accused of having sex with an underage girl.

Casey Ortiz, charged with sexual assault of a minor, appeared in court to hear new evidence against him. A second teenager is now accusing Ortiz of having sex with her while the officer was on duty.

“He unzipped his cop shirt, and took off his belt, took off his vest,” said the now 18-year-old in court Thursday.

The woman says she met Ortiz in May 2013 when she was 16 years old after running away from a rehab center in Fort Myers. Ortiz was tasked with taking her back, but on the way, she says Ortiz parked and she gave him oral sex in the back of his patrol car.

In court, Ortiz’s defense attorney Joe Viacava called her testimony unreliable, saying “she didn’t have an answer to anything, she didn’t have an answer as to why it was reported two years later. Notice there’s not a separate case. If it was really such a bad act, how come there is no other crime?”

Ortiz is not being charged with the new allegations, however the State Attorney’s Office says they want to use the second woman’s testimony to show motive in the first case.

“I believe it is done to bolster the original allegation and try to argue if there’s two people, he must be guilty,” said Viacava.

The first victim, who was 16 years old at the time, says she had sex with Ortiz at his home at least two times, while he was on duty.

A judge will now decide if the new accusation will be allowed in Ortiz’s trial scheduled for November.
