3 nurseries seek injunction against Florida Dept. of Health

TALLAHASSEE, Fla. (AP) – Three nurseries have filed a lawsuit asking for an injunction to delay Florida’s medical marijuana process.

McCrory’s Sunny Hill Nursery, San Felasco Nurseries and Tornello Landscape 3 Boys Farm’s filed the lawsuit Tuesday in Leon County Circuit Court against Florida’s Department of Health and the approved nurseries. The three nurseries want the process put on hold until all administrative challenges are heard.

Four of the five regions have challenges pending with Florida’s Department of Administrative Hearings. An administrative judge said in a Jan. 22 order that the Department of Health lacks the authority to issue final licenses but that DOAH can’t halt the process.

Christian Bax, the director of DOH’s Office of Compassionate Use, testified before a Senate committee on Jan. 13 that they were continuing despite the challenges.
