FORT MYERS, Fla.- The State Attorney’s Office has filed notices of intent to seek the death penalty for Mark Sievers and Jimmy Rodgers in the high-profile murder case of Teresa Sievers.
Mark Sievers is charged with first-degree murder in the bludgeoning death of his wife that took place nearly a year ago.
If the cases proceed to a sentencing phase, a jury and judge would decide the penalties.
“We are not surprised,” said Sievers’ attorney Antonio Faga. “Bit disappointed our client will face the ultimate penalty for what we see is a lack of evidence.”
Mark Sievers is accused of hiring Rodgers, who is also charged with first-degree murder, and his childhood friend, Wayne Wright, to murder his wife while he was out of town.
Wright accepted a plea deal in exchange for testifying against Rodgers and Mark Sievers.
