FSW sex assault video may be used as evidence in court

SOUTH FORT MYERS, Fla. — An FSW student was allegedly raped over the weekend during a party in her dorm room and a video of the assault has been circulating online, according to Lee County deputies.

However, criminal defense lawyer Lance Dunford believes that video could be used as evidence if the case goes to court.

“Videos are consider objective evidence, they kind of speak for themselves” Dunford said. “So that’s something that a jury or a prosecutor making a decision is going to be able to review and make a determination based on what they’re seeing with their own eyes versus what a victim may tell them what happened.”

Dunford also said the video itself could elevate the charges.

Lee County deputies haven’t disclosed whether they have anyone in custody.
