Zombicon victim to sue City of Fort Myers

FORT MYERS, Fla. — One of the six people injured during the Zombicon shooting last year plans to sue the City of Fort Myers.

Attorney Sawyer Smith signed an official notice to file a lawsuit on behalf of client David Perez in front of WINK News cameras Wednesday.

The 22-year-old Perez, who suffered broken bones in both hands and wounds all over his body, joins multiple other victims who’ve taken legal action in the wake of the Oct. 17, 2015 attack that killed 20-year-old Expavious Tyrell Taylor of Okeechobee.

Perez will be the first Zombicon victim to sue the city. He previously filed suit against the organizer, Pushing Daizies, and the security company hired for the event, Southwest Florida Security and Investigations.

No arrests have been made for the shooting, and the Fort Myers Police Department declined to elaborate on its investigation this week in advance of the one-year anniversary of the attack.

Zombicon, a public zombie-themed festival, was authorized by the city.

“Not only is Pushing Daizies and the security company responsible for this negligent behavior, but the City of Fort Myers, who allowed this event to take place without a proper security plan, without proper entrance and exit points, is also negligent,” Smith said.

City officials did not respond to requests for comment from WINK News.
