David Erb changes to guilty plea, gets 12 years in prison 10 years probation

A man was sentenced to 12 years in prison after changing to a guilty plea in court on Monday.

David Erb, 27, was charged with Homicide-Negligent Manslaughter (Aggravated of Child) and Aggravated Child Abuse.

According to the 20th judicial circuit in and for Lee County, Florida, Erb was arrested for the death of a 17-month-old boy with methamphetamines in his system.

Erb was sentenced to 12 years in prison and then 10 years of probation and changed to a guilty plea on Monday.

According to Sheriff Carmine Marceno, around 1 a.m. on Feb. 15 deputies responded to a 911 call at the 7800 block of Bartholomew Drive in North Fort Myers.

Marceno said the toddler had enough amphetamines in his system to kill or seriously impair an adult, according to the toxicology report.

“David Erb willfully subjected an innocent child to a dangerous environment, and his absolute negligence resulted in this tragic death. I’m saddened for the victim and his family, but proud of my dedicated team who didn’t stop until justice could be served,” Sheriff Marceno said.

Erb was arrested for aggravated manslaughter of a child on Dec. 14.
