Witness not cooperating with murder investigation of 5-year-old boy

FORT MYERS, Fla.- Officials say a key witness is not cooperating in the investigation of a 5-year-old boy who was gunned down.

“I want the truth, just like everybody else does.”

Toyetta Simpson is still looking for the answers, as to what exactly happened the night her son Andrew Faust Jr., was killed in a drive-by shooting.

“Don’t forget. He was innocent and this was a senseless crime,” said Simpson.

Police have two men in jail for the boy’s murder. Officers say the men were identified by one main witness, who helped crack the case.

As the case moves forward, WINK News has learned the witness isn’t cooperating with the State Attorney’s Office.

The witness at their request will be relocated. That’s what Fort Myers Police Chief Doug Baker said, the day of the arrests last October. So what happened to scare the witness away?

As a result of the still active investigation, no one is talking, and neither the Fort Myers Police Department or the State Attorney’s Office can confirm if the witness was ever relocated.

“We are back at ground zero,” said Trish Routte, of Southwest Florida Crime Stoppers.

Routte says they see a lot of this, but there’s not much law enforcement can do.

“I can’t force someone to do something they aren’t willing to do,” said Routte.

Meanwhile, the State Attorney’s Office told a judge Monday, they still have the witness’s original statement.

The defense for one of the suspects, Terrance Irons, says it’s no good, because the story the witness provided changed several times.

“The violence ends, when people start talking,” said Routte.

“I need everyone to remember what happened to him and what happened to me,” said Simpson.
