CAPE CORAL, Fla. – A son is being questioned as Cape Coral police investigate the death his father, 58-year-old James Richard Marshall, who was reported missing on Feb. 19, according to detectives.

Police said they tried interviewing James Marshall’s son, 33-year-old Matthew Marshall, after he was arrested Monday on separate fraud charges. Matthew was caught using his father’s credit card at Backstreets Sports Bar Feb. 17, which was the day after his father disappeared, according to arrest records.

Monday night, police were seen removing evidence from an apartment at Island Cove Condos, off Four Mile Cove Parkway, near James’ home. Cape Coral police and Lee County deputies searched a nearby canal on Tuesday and neighbors said they saw authorities searching a wooded area, as well.

“We asked them what they were looking for and they said ‘Well, we’re not real sure’ and that’s all they would say,” a neighbor said.

CCPD confirmed that James Marshall’s missing person’s case was changed to a death investigation.

On Tuesday, Detectives’ investigation continued as details unfolded about James Marshall’s whereabouts before his disappearance.

His best friend, Ray Alexander, said on the day he disappeared James dropped off his white BMW to a mechanic in Cape Coral and sent one of his last emails.

Police later discovered James’ car at an undisclosed location.

James also stopped at The Office Pub on S Cleveland Avenue, where bartender Bill Helberg served him. Helberg said he did not notice anything unusual.

“Nothing seemed odd to me,” Helberg said. “Not at all. He mentioned nothing to me or anything.”

James was reported missing by family members on Feb. 19 after he did not show up for a conference in California, Cape Coral police said.

The conference was a work event, Alexander said.

“He travels for his work and when he didn’t show up for his convention in California they knew something was up,” he said.

Matthew Marshall has not been named as a suspect in his father’s disappearance. But Alexander said Matthew was living with his father at his Island Cove condo.

“Matt was going through a rough time so he had let Matt come in to his home and live with him,” Alexander said of James.
