Cape Coral officer cleared in 2016 officer-involved shooting

CAPE CORAL, Fla. An officer who returned fire during a March 2016 incident involving an armed man acted within department policy, Cape Coral police said Friday.

Officer Cristian Munoz-Luna, who was on administrative leave since the incident, was cleared to return to duty February 9, said Lt. Dana Coston, department spokesperson.

John Toles, 66, emerged from his Northwest 12th Street home with a weapon and shot at police, forcing Munoz-Luna to return fire, the department said. Toles was found dead after officers entered the home.

Toles was battling cancer and going through a rough time, a nearby resident said at the time.
No officers were injured in the shooting.

Toles lived in the home with his wife and mother-in-law. Both made it out safely, officials said.
