Cape Coral City Council discusses Waste Pro lawsuit in private meeting

A trash fight is back on the table for Cape Coral’s city council. City leaders are discussing the next steps of a lawsuit with Waste Pro’s attorneys.

The company accused the city of not paying for its services after the city said Waste Pro didn’t hold up its end of the bargain when it let trash pile up on the streets.

Many people in Cape Coral have voiced their complaints about the trash issue to the city council.

“It sits and sits out there,” said Cape Coral resident Craig Lantz.

“Why do I have to keep calling every week?” asked Cape Coral resident Barbara Anderson.

“They don’t come consistently. They don’t come on the day that they’re scheduled to come,’ said Cape Coral resident Judy Buczko.

Now, Waste Pro has complaints of its own with the city. In March, Waste Pro filed a lawsuit accusing the city of assessing damages that bear no reasonable relationship to any performance issues. The company said those damages were calculated in violation of their contract.

On Tuesday, Cape Coral City Council met behind closed doors to discuss the lawsuit, settlement negotiations and litigation expenditures.

Council met for more than an hour, but no one would say what they discussed.

Waste Pro has also not commented on the talks. The company is demanding between $30,000 and $50,000 in damages.
