
FORT MYERS, Fla.- Mark Sievers’ attorney filed a motion to strike the State Attorney’s Office intention of seeking the death penalty for Sievers in the high-profile murder case of his wife.
In order to seek the death penalty, prosecutors must present a list of “aggravating factors the state intends to prove… [and] can prove beyond a reasonable doubt.” Something Sievers’ attorney, Antonio Faga, says the state “fails” to do.
Mark Sievers is charged with first-degree murder in the bludgeoning death of his wife in June 2015.
