The kidnapping and sexual assault of a young girl Wednesday morning did not meet the criteria for an AMBER Alert, the Lee County Sheriff’s Office said Thursday. The agency did not provide further explaination. The following criteria must be met for an AMBER alert to be issued, according to the Florida Department of Law Enforcement: The child must be under 18 years of age. There must be a clear indication of an abduction. The law enforcement agency’s preliminary investigation must conclude that the child’s life is in danger. There must be a detailed description of child, abductor and/or vehicle to broadcast to the public. The activation must be recommended by the local law enforcement agency of jurisdiction. William Devon Cole, 33, of Paul Avenue in Lehigh Acres, faces charges of kidnapping/false imprisonment of a child with sexual battery, sexual assault/battery victim under 12 years of age and cruelty to a child without great bodily harm. Cole remained in the Lee County Jail on Thursday under a $135,000 bond. Cole visited a Home Depot with the girl Tuesday afternoon, then was spotted at a drug house with the girl that evening, according to the girl’s mother, as stated in an incident report. “Cole has been known to be a heavy drug user and she is worried for the safety of her daughter,” the report said. The girl was reported missing by her mother just before midnight Wednesday, the report said. Four hours later, a relative spotted Cole in the area of 2990 Edison Ave. in Fort Myers. Cole’s vehicle was found in the area of Cranford and Lafayette streets at about 5 a.m. Wednesday. Cole was later found hiding behind a home on Charles Street. Cole was apprehended following a vehicle and foot pursuit, according to a Fort Myers police report, but it was not immediately clear if officers were involved in the pursuit.
