Tobacco Trial outcome now in jury’s hands

CHARLOTTE COUNTY, Fla.-Jurors are deliberating as to whether or not a Port Charlotte man is entitled to money from tobacco companies after his wife died of cancer. It’s the first trial of its kind in Charlotte County.

Donald McMannis, 82, is suing two of the country’s largest tobacco manufacturers–Philip Morris USA and R.J. Reynolds Tobacco Company. Closing arguments ended Wednesday. For the past two weeks, jurors heard testimony from doctors, experts and family members about nicotine addiction.

For McMannis to win the case, attorneys must convince jurors that Donald’s late wife, Barbara McMannis, was addicted to cigarettes and that the addiction is what led to the cancer that eventually killed her.

In closing arguments today, attorneys stressed the role cigarettes played for almost the entirety of Barbara’s life. Family says Barbara smoked all day long. They say she smoked first thing in the morning when she woke up.

The defendants believe her former job shows she wasn’t addicted. For years, Barbara worked in a factory where she packaged bottles, making her unable to smoke during this time. Their point is she controlled her habit and that it did not control her.

The jury will meet again on Thursday morning to deliberate.
