Homicide charges added in Diana Avenue overnight shooting

Homicide charges have been added in a shooting that happened on Diana Avenue on Friday, Sept. 6, according to Fort Myers Police.

FMPD responded to the shooting around 12:30 a.m. Friday.

Upon arrival, they found 55-year-old Jose Bermudez suffering from a gunshot wound.

Bermudez was taken to Lee Memorial Hospital by ambulance. As of Monday, Sept. 9, he had succumbed to his injuries.

Officers quickly learned that his neighbor, Luis Orgeta, 61, had been arguing with the victim, shot him then returned to his residence.

Officers attempted to take Ortega into custody, but he refused to surrender.

The Fort Myers Police SWAT team, Critical Incident Negations team and Detective Division were called to assist.

More than a dozen officers swarmed a cluster of public housing apartments as police ordered Ortega to surrender.

The standoff went on for nearly two hours while officers called through a bullhorn for him to come out with his hands up.

Ortega was then taken into custody without further incident and was initially charged with attempted murder, armed burglary and aggravated assault. His charges have now been increased to include second-degree homicide.

The investigation is active and ongoing.
