MIAMI (AP) – Trial of a Pakistani-American man’s lawsuit accusing the U.S. of malicious prosecution in a terror financing case has been delayed for months amid disputes over classified material.

A Miami federal judge postponed Irfan Khan’s case from June 2015 to October 2015 to allow the FBI more time to sift through hundreds of secret telephone intercepts. Khan’s attorney also seeks a large amount of classified FBI documents as evidence in the case.

Khan claims the Justice Department prosecuted him on terror support charges despite knowing he was innocent. Prosecutors have denied that, but the criminal case against him was abruptly dropped before trial.

Khan’s father, Muslim cleric Hafiz Khan, is serving a 25-year sentence after he was convicted in 2013 of sending thousands of dollars to support the Pakistani Taliban.
