NAPLES, Fla. — A 30-year-old man accused of killing his own mother had his first court appearance Tuesday.

Yuzo Nishi is facing second-degree murder charges after his mother, 51-year-old Maria Bertalmio, was found dead Sunday night.

Jose Nunez, Nishi’s attorney, attempted to get the murder charge downgraded to manslaughter, saying that while there was obviously a disagreement between the two, nothing in the records show he’s guilty of any criminal intent.

However, the judge disagreed.

He said even though Nishi did call 911, the wounds on his hands were consistent with those on his mother’s body and ordered him to stay in jail.

The judge also forced Nishi to turn in his passport and issued a no-trespass order for the mobile home he shared with his mother.

If convicted, Nishi faces life in prison.
